Terms
These terms govern enrolment on and participation in the courses offered by IDC Tenerife Canary, the trade name under which Salvatore Giglione operates, Avenida de Rafael Puig Lluvina 9, 38660 Adeje, Santa Cruz de Tenerife, Spain (email: idctenerifecanary@gmail.com): PADI professional courses (Divemaster and internships, Assistant Instructor, Instructor Development Course, EFR Instructor, MSDT and Instructor Examination preparation), PADI specialties and TecRec courses, plus related services such as accommodation for course participants.
1. Course enrolment
Enrolment on courses and related services (accommodation, equipment rental included in packages, training materials) is subject to availability and to confirmation by IDC Tenerife Canary.
A booking is considered confirmed once the required deposit or payment has been received.
The customer must provide correct and complete information about their diving experience, certifications, health conditions and any other information relevant to carrying out the activity.
2. Cancellation by the customer
If the customer cancels for any reason, including changes to travel plans, changes to itinerary, personal problems, illness or a simple change of mind, the deposit or amount already paid is non-refundable.
IDC Tenerife Canary may, at its own discretion and subject to its availability, offer the customer the option of changing the date of the activity.
Any change of date is not a right of the customer and will only be possible if the new date is compatible with the availability and organisation of IDC Tenerife Canary.
If it is not possible to change the date, the deposit or amount paid will be retained and will not be refunded.
These terms apply without prejudice to any mandatory rights granted to consumers by applicable law.
3. Prices, payments and PADI fees
Course and package prices are those shown on the website or in the offer sent to the client and include only the services expressly listed.
Unless stated otherwise, the price does not include PADI training materials (for example Crew Packs and eLearning), PADI application and certification fees or Instructor Examination (IE) fees, which are shown separately.
Payment can be made by bank transfer, card, PayPal or cash, as agreed at the time of enrolment.
Fees already paid to PADI on the client’s behalf and training materials or eLearning already activated are not refundable, as their cost has already been incurred.
4. No-shows and delays
The customer is responsible for arriving on time at the place and time communicated by IDC Tenerife Canary.
Failure to arrive without prior notice (no-show) will be considered a cancellation by the customer and will not give rise to any refund.
A delay by the customer that makes it impossible or unsafe to carry out the activity may result in the loss of the booking, without any right to a refund.
IDC Tenerife Canary will do its best to assist the customer in the event of a delay, but cannot guarantee that the activity will take place when the delay compromises the organisation, departure times, safety or the participation of other customers.
5. Flights, transfers and travel plans
Any delays, cancellations or changes to the customer's flights, transfers or travel plans do not give rise to a refund for activities booked and not carried out.
The customer is responsible for organising their trip so as to respect the times of the booked activities.
Where possible, IDC Tenerife Canary may consider changing the date of the activity, but such a change is subject to availability and remains at the discretion of IDC Tenerife Canary.
6. Cancellation by IDC Tenerife Canary
The safety of our customers is our highest priority.
IDC Tenerife Canary may decide to cancel or suspend a dive when sea conditions, wind, bad weather, visibility, currents or other environmental or operational conditions do not allow the activity to be carried out safely.
When IDC Tenerife Canary cancels an activity for these reasons and no alternative activity is agreed, the customer will receive a 100% refund of the amount paid for the cancelled service.
The assessment of safety conditions and the final decision on whether the dive can take place rest with IDC Tenerife Canary and the professionals responsible for the activity.
7. Changes to the dive site or dive plan
Sea and weather conditions can change and, for safety reasons, IDC Tenerife Canary may change the dive site, depth, profile, time or other arrangements of the activity.
When the dive can be carried out safely at a suitable alternative site, the change of site does not constitute a cancellation of the service and does not give rise to a refund.
The choice of site and dive plan will be made taking into account environmental conditions, the certifications and experience of the participants and the operational conditions at the time.
8. Boat dives
For boat dives, IDC Tenerife Canary uses external companies specialising in nautical services.
Matters relating exclusively to the management of the boat, the crew or the nautical service are the responsibility of the relevant provider.
Any complaints concerning problems directly attributable to the boat or the nautical service must be addressed to the relevant service provider.
IDC Tenerife Canary will cooperate with the customer, within the scope of its responsibilities, in handling any issues.
9. Diving insurance
Recreational diving in Spain requires insurance covering accidents and civil liability arising from diving activities.
The customer may purchase insurance through IDC Tenerife Canary or present their own valid insurance appropriate to the activity and to the period of the booking.
A customer who declares that they hold their own insurance is responsible for verifying that the policy is valid, in force and appropriate to the diving activity they intend to carry out.
IDC Tenerife Canary will not be liable for any lack of cover resulting from a policy that is non-existent, expired, invalid or not appropriate to the activity declared by the customer.
10. Insurance during courses
Dive insurance is included in the price only when it is expressly stated in the description of the course or package (for example in the Divemaster plan).
In all other cases, participants must hold their own valid insurance or buy it through IDC Tenerife Canary before the course starts.
11. PADI documentation and mandatory forms
Before taking part in a course, the client must complete and sign all documentation required by PADI, by IDC Tenerife Canary and by applicable law.
Depending on the activity, the documentation may include the Diver Medical Participant Questionnaire, documentation relating to risks and liability, assumption of risk statements, safe diving practices statements and any other form required by PADI standards or by applicable law.
The customer must read the documentation carefully before signing and provide complete and truthful information.
If the required documentation is not correctly completed, signed or provided, or if the customer does not meet the requirements necessary to take part in the activity, IDC Tenerife Canary may refuse or suspend participation in the activity.
If the inability to participate is due to the customer, the cancellation conditions set out in these Terms and Conditions apply and no refund will be given.
Completing and signing the PADI documentation does not replace the customer's obligation to hold valid diving insurance where this is required.
12. Collection and storage of user data
In order to carry out diving activities, IDC Tenerife Canary is required to collect and store the data and documentation necessary to identify users and to correctly manage and record the activities carried out.
Depending on the activity, such data may include first and last name, identity document or passport, contact details, diving certification, insurance, information about the dives carried out and the documentation required by applicable law and by PADI standards.
This information is collected and stored to enable IDC Tenerife Canary to fulfil the obligations laid down by applicable law and to provide, when legally required, the relevant documentation to the competent authorities of the Government of the Canary Islands, to other competent public authorities or to authorised bodies.
The customer must provide correct and complete information and present the required documentation before taking part in the activities.
Refusal to provide the mandatory data or documentation may make it impossible to take part in the activity.
Personal data will be processed and stored in compliance with applicable data protection law and as set out in the IDC Tenerife Canary Privacy Policy.
13. Certification, experience and documentation
A certified diver must be able to prove, when requested, that they hold the appropriate certification for the booked activity.
IDC Tenerife Canary may request information about the diver's recent experience, the number of dives completed and the date of their last dive, in order to assess whether the requested activity is suitable.
The customer is responsible for correctly declaring their level of certification and experience.
14. Health and fitness to dive
Every diver is responsible for ensuring that their physical condition and health are compatible with diving.
Before the activity, the customer must correctly complete the required health documentation and inform IDC Tenerife Canary of any medical condition, medication or change in their condition that could affect the safety of the dive.
If the declared conditions require a medical assessment, the customer must obtain the required medical clearance before carrying out the activity.
IDC Tenerife Canary may refuse or stop an activity if it considers that the customer is not in the condition necessary to take part safely.
Taking part in activities under the influence of alcohol, drugs or other substances that may impair the abilities needed to carry out the activity safely is not permitted.
15. Diver responsibility and dive limits
Every certified diver is responsible for respecting the limits of their own certification, experience, equipment and dive planning.
The diver is responsible for knowing and following the procedures relating to decompression, off-gassing and the no-fly time after diving.
It is also the diver's responsibility to know and follow the procedures relating to going to altitude after a dive, including any stays in places located at significant altitude.
The diver must follow the indications of their dive computer, of the tables used and of the safety standards applicable to their activity.
IDC Tenerife Canary may provide general safety guidance, but respecting personal dive limits, the no-fly time and the procedures relating to going to altitude remains the responsibility of the diver.
16. Safety and conduct of the dive
The customer must follow all instructions given by the instructors, guides and staff of IDC Tenerife Canary.
The customer must also respect the limits set by their certification and by the activity being carried out.
IDC Tenerife Canary may change the depth, site, profile or arrangements of the activity where this is necessary for safety reasons.
If the customer does not follow the safety instructions or behaves in a way that may put themselves, other participants or staff at risk, IDC Tenerife Canary may stop the activity.
If the activity is stopped because of the customer's behaviour or conduct, no refund will be given.
17. PADI Instructor Examination (IE)
The Instructor Examination (IE) is organised and assessed by independent PADI examiners, not by IDC Tenerife Canary.
IE dates are set by PADI. If PADI changes or cancels a date, IDC Tenerife Canary will adapt the course schedule to the next available date.
IDC Tenerife Canary prepares candidates for the exam but cannot guarantee that they pass. IE fees are paid to PADI, and any retake is subject to the fees set by PADI.
18. Courses and certifications
Participation in courses is subject to meeting the requirements of the training programme and of the relevant certifying organisation.
Payment for the course does not automatically guarantee that the certification will be obtained.
Certification is issued only upon completion and successful fulfilment of all the theoretical, practical and safety requirements of the programme.
If the participant does not meet the requirements needed to obtain the certification, the course may require additional training as provided by the programme and by the certifying organisation.
No full or partial refund will be due from IDC Tenerife Canary.
19. Rental equipment
Equipment provided by IDC Tenerife Canary must be used correctly and in accordance with the instructions received.
The customer is responsible for the equipment entrusted to them during the period of use and must return it in the condition in which it was handed over, except for normal wear and tear resulting from correct use.
In the event of loss, theft, breakage or damage caused by negligence, misuse or behaviour attributable to the customer, the cost of repairing or replacing the equipment may be charged.
In the event of replacement, the cost actually incurred by IDC Tenerife Canary to purchase an equivalent new product will be charged, without any mark-up.
20. Accommodation for course participants
Where stated for the course or package, IDC Tenerife Canary may offer accommodation in its student apartments, always subject to availability.
By law, guests must provide a valid identity document and the details required for guest registration with the Spanish authorities.
Guests must follow the house rules and are responsible for any damage caused through negligence or misuse.
If accommodation is not available, IDC Tenerife Canary will say so before confirming the enrolment.
21. Internships and career support
Job-search advice, CV help and contacts with other dive centres are a support service: IDC Tenerife Canary does not guarantee a job offer or employment.
Internship programmes do not constitute an employment relationship unless agreed otherwise in writing.
IDC Tenerife Canary shares the client’s CV or details with potential employers only with the client’s consent, as described in the Privacy Policy.
22. Personal belongings
The customer is responsible for their personal belongings during activities and at the dive center.
IDC Tenerife Canary is not liable for the loss, theft or damage of personal belongings left at the dive center, in vehicles or during activities, except in cases of liability provided for by applicable law.
23. Photos and videos
Photos or videos of participants may be taken during activities.
Any use of recognisable images of the customer for promotional or commercial purposes will be carried out in compliance with applicable law on personal data protection and image rights and with the relevant authorisations.
24. Intellectual property and website content
All content on the IDC Tenerife Canary website, including, by way of example, texts, photographs, images, videos, graphics, logos, trademarks, graphic elements, layout, descriptions of services and courses and other materials, is owned by IDC Tenerife Canary or is used lawfully on the basis of the relevant rights, licences or authorisations.
Such content is protected by the laws in force on intellectual property, copyright and industrial property.
Reproduction, copying, modification, distribution, publication, sale or any other use of the content of the website, in whole or in part, without the prior written authorisation of IDC Tenerife Canary is prohibited, except for uses expressly permitted by law.
The name IDC Tenerife Canary, its logo and any other trademarks used by IDC Tenerife Canary may not be used without prior authorisation.
Photographs and audiovisual materials published on the website may be protected by copyright and/or image rights. Downloading, republishing or using them for commercial or promotional purposes without the prior authorisation of the holder of the relevant rights is prohibited.
Simply accessing the website or using its services does not entail any transfer or grant of intellectual property rights over the content on the website.
25. Liability
IDC Tenerife Canary organises and carries out its activities in compliance with applicable law and with the safety procedures established for diving activities.
The customer must follow the instructions received and accept responsibility arising from false, incomplete or omitted information, from breach of safety procedures or from negligent use of equipment.
These terms do not exclude or limit any liability that cannot legally be excluded or limited under applicable law.
26. Right of withdrawal
If the contract is concluded at a distance (for example by email, WhatsApp or phone), consumer clients generally have the right to withdraw within 14 days of concluding the contract, without giving a reason, by writing to idctenerifecanary@gmail.com.
The right of withdrawal does not apply to leisure and accommodation services where the contract provides for a specific date or period of performance, under Article 103 of Spanish Royal Legislative Decree 1/2007 (General Law for the Protection of Consumers and Users).
If the client expressly asks for the course to start before the end of the withdrawal period, they must pay for the part of the service already provided if they withdraw. The right of withdrawal also does not apply to digital content, such as PADI eLearning, once activated with the client’s consent.
In the event of a valid withdrawal, IDC Tenerife Canary refunds the amounts received within 14 days, using the same payment method used by the client.
27. Complaints
Clients can send any complaint to idctenerifecanary@gmail.com. We will reply as soon as possible and in any case within one month.
Official complaint forms (hojas de reclamaciones), as required by Canary Islands regulations, are available to clients and can be requested at any time.
Clients may also contact consumer protection offices or the consumer arbitration system.
28. Privacy
The processing of personal data is governed by our Privacy Policy, available on the IDC Tenerife Canary website.
29. Applicable law
These terms are governed by the laws in force in Spain, by the applicable laws of the Autonomous Community of the Canary Islands and by the European Union law applicable to consumer relations.
In the event of a dispute, the mandatory rights and protections granted to consumers by the laws in force will be respected.
